Throughout the website, the terms “I,” “me,” and “my” refer to Zhanna Samsonova. The terms “you” and “your” refer to visitors to the website and customers purchasing products through the website.
By visiting this website, placing an order, or purchasing artwork or other products from me, you agree to these Terms of Service and to the policies referenced in them, including my Privacy Policy, Shipping Policy, Refund Policy, and Damaged Artwork & Shipping Claims Policy.
Please read these Terms carefully before using the website or placing an order.
Nothing in these Terms limits or excludes any consumer rights that cannot legally be limited or excluded under applicable law.
This online store is hosted by Shopify, which provides the e-commerce platform used to offer products and process orders.
1. Online Store Terms
By placing an order through this website, you confirm that you are legally capable of entering into a binding contract in your jurisdiction.
You may not use this website or its products for any unlawful or unauthorized purpose or in any way that violates applicable laws, including copyright and intellectual property laws.
You must not transmit malicious code, viruses, or other technology intended to interfere with the operation or security of this website.
I reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, payment issues, pricing errors, unauthorized resale, or misuse of the website.
If an order that has already been paid for is cancelled by me, the amount paid for the cancelled item will be refunded in accordance with applicable law.
2. Original Artwork
Original artworks offered through this website are unique, one-of-a-kind works created by hand.
Because each original artwork is handmade, characteristics such as visible brushstrokes, texture, layering, surface variation, edges, and other natural variations are part of the artwork and are not considered defects.
Measurements are provided as accurately as reasonably possible, but minor variations may occur.
Any framing, hanging hardware, signature placement, or other details specifically included with an artwork will be described on the applicable product page where relevant.
Once an original artwork has been sold, it may no longer be available for purchase.
Returns of original artwork are governed by my Refund Policy and any mandatory consumer rights that apply to the purchase.
3. Fine Art Prints
Fine art prints may be produced after an order is placed and may be fulfilled by a professional printing or framing partner.
Depending on the product selected, prints may be offered in different sizes, materials, finishes, framing options, or formats.
Minor variations may occur between an image displayed online and the finished print due to production methods, materials, sizing, cropping, and other normal manufacturing factors.
Returns of fine art prints are governed by my Refund Policy.
4. Colours and Images
I make every reasonable effort to photograph and display artwork as accurately as possible.
However, colours, brightness, contrast, scale, and texture may appear differently depending on your device, screen settings, lighting conditions, browser, and the characteristics of digital photography.
Original paintings may also appear different under natural light, artificial light, or at different times of day.
These normal differences are not considered defects.
This section does not affect your rights if the product you receive is materially different from its description or if applicable consumer law provides otherwise.
5. Intellectual Property and Copyright
All artwork, paintings, drawings, designs, photographs, videos, written content, product images, collection names, graphics, and other original content displayed on this website are owned by or licensed to Zhanna Samsonova and are protected by applicable copyright and intellectual property laws.
Purchasing an original artwork or fine art print gives you ownership of the physical item only. It does not transfer copyright or any other intellectual property rights in the artwork to you.
Unless I provide prior written permission, purchasing an artwork does not give you the right to:
- reproduce or copy the artwork;
- create or sell prints or reproductions of it;
- use the artwork on merchandise or commercial products;
- use the artwork for advertising, branding, or other commercial purposes;
- alter the artwork and commercially distribute the altered version;
- mint, tokenize, or sell the artwork as an NFT or other digital asset;
- license the image to another person or business; or
- otherwise commercially exploit the artwork or its image.
You may display an artwork or print you have purchased for your own personal use.
I retain all copyright and reproduction rights in my artwork unless those rights are expressly transferred through a separate written agreement signed by me.
I may continue to photograph, publish, display, promote, reproduce, license, or create prints or other authorized reproductions of an original artwork after the physical original has been sold, unless I have expressly agreed otherwise in writing.
6. Personal and Commercial Use
Products sold through this website are intended primarily for personal use and collection.
Purchasing artwork does not authorize the purchaser to reproduce it for commercial interiors, products, publications, advertising, merchandise, branding, or resale of reproductions.
Interior designers, galleries, publishers, brands, hospitality businesses, and other commercial clients who wish to license an artwork should contact me to discuss licensing separately.
The lawful resale of the physical original artwork or physical print itself is not prohibited by this section.
7. Product Availability
Original artworks are unique and available in limited quantities.
Fine art prints, special releases, editions, sizes, or framing options may also be limited or discontinued.
Adding an item to your cart does not reserve it.
An order is subject to acceptance and availability.
In the rare event that the same unique artwork is purchased simultaneously by more than one customer or becomes unavailable because of a technical or inventory error, I may cancel the affected order and issue a full refund.
8. Prices and Currency
Prices displayed on the website may vary depending on the country or region selected.
Where the website displays prices in different currencies, currency conversion may be provided through Shopify or another payment or localization service.
Your bank, credit card provider, PayPal, or other payment provider may apply its own exchange rate or foreign transaction fees. I do not control those charges.
Prices may change at any time before an order is placed.
Once an order has been accepted, later price changes do not affect that order, except where an obvious pricing or technical error has occurred and applicable law permits the order to be corrected or cancelled.
Applicable taxes may be added or collected at checkout where required.
9. Orders and Payment
You agree to provide current, complete, and accurate billing, payment, and shipping information when placing an order.
I reserve the right to refuse, limit, or cancel an order where reasonably necessary, including where:
- payment cannot be authorized;
- information provided appears inaccurate or fraudulent;
- an obvious pricing or inventory error has occurred;
- an item is no longer available;
- the order appears to be made for unauthorized commercial resale; or
- fulfilling the order would violate applicable law or shipping restrictions.
If I cancel an order after payment has been successfully collected, I will refund the applicable amount to the original payment method.
10. Shipping
Shipping destinations, available shipping methods, estimated delivery times, tracking, customs information, and other shipping conditions are described in my Shipping Policy.
Delivery dates and transit times are estimates unless expressly stated otherwise.
International shipments may be delayed by customs authorities, carriers, weather, holidays, or other circumstances outside my reasonable control.
Customers are responsible for providing a complete and accurate shipping address.

11. Customs, Duties and Import Taxes
Orders shipped internationally may be subject to customs duties, VAT, import taxes, brokerage fees, or other charges imposed by the destination country.
Unless expressly stated at checkout that such charges have been collected, these costs are the responsibility of the customer to the extent permitted by applicable law.
I am not responsible for customs processing times or delays caused by customs authorities.

12. Returns and Refunds
Returns, exchanges, cancellations, and refunds are governed by my Refund Policy.
Different return conditions may apply to original artworks, fine art prints, customized products, framed products, and other items.
Nothing in these Terms or in my Refund Policy limits any mandatory consumer cancellation, refund, repair, replacement, or other rights that apply under the laws governing your purchase.
Customers in jurisdictions including the European Union and United Kingdom may have statutory rights relating to online purchases that apply regardless of my voluntary return policy.
Please review the Refund Policy before placing your order.
13. Damaged, Defective or Incorrect Orders
Please inspect your order promptly after delivery.
If your artwork or print arrives damaged, defective, or incorrect, please contact me as soon as reasonably possible.
Photographs of the artwork, shipping box, internal packaging, shipping label, and visible damage may be requested to allow me to assess the issue and submit a carrier or production claim.
Please retain the original packaging until the issue has been resolved.

Nothing in this section limits any mandatory consumer rights available to you under applicable law.
14. Shipping Address and Undeliverable Orders
You are responsible for providing accurate shipping information when placing an order.
If you notice an error before shipment, please contact me as soon as possible.
Once an order has been shipped, I cannot guarantee that the delivery address can be changed.
If an order is returned because an address was incorrect or incomplete, delivery was repeatedly unsuccessful, or the shipment was refused or left unclaimed, additional shipping and carrier charges may apply to the extent permitted by applicable law.
15. Gift Cards and Promotions
Gift cards, discount codes, promotions, and special offers may be subject to additional terms displayed at the time they are offered.
Unless otherwise stated, discount codes cannot be combined.
Promotional codes cannot normally be applied retroactively to orders already placed.
Gift cards are non-refundable and are not redeemable for cash except where required by applicable law.
I reserve the right to cancel or refuse the use of a promotion in cases of fraud, misuse, or obvious technical error.

The information on this website is provided for general informational and shopping purposes.
I make reasonable efforts to ensure that product descriptions, dimensions, prices, availability, shipping information, and other information are accurate.
Occasionally, the website may contain typographical errors, inaccuracies, or omissions.

You remain the owner of your original content.
Where you knowingly submit content for publication, you grant me a non-exclusive, worldwide, royalty-free licence to display, reproduce, and use that submitted content for operating and promoting my art business, website, and related social media, unless we agree otherwise.
I will not knowingly publish private customer communications as testimonials without permission where permission is required.
I may remove content that is unlawful, abusive, misleading, infringing, fraudulent, or otherwise inappropriate.

These Terms and the use of this website are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Where legally permitted, disputes relating to these Terms will be subject to the courts of Alberta, Canada.
